Liability Waiver

Flipz Academy Pty Ltd Indoor Trampoline Park & Super Performance Centre Pty Ltd is a supplier of recreational and other related services.

All activities enjoyed at Flipz Academy Indoor Trampoline Park and Gymnastics Centre are subject to these conditions of entry.

DANGEROUS RECREATIONAL ACTIVITY

The services provided at Flipz Indoor Trampoline Park are recreational activities.

Activities engaged in at Flipz Indoor Trampoline Park can be dangerous. Participating in the activities involves performing manoeuvres on various equipment while being in proximity to others.

Performing those manoeuvres may result in an unintended act such as (but not limited to) landing awkwardly, falling and suffering injury or colliding with another person which can result in serious personal injury including sprains, twists, broken bones, spinal injury, paralysis, and other physical injury and/or death.

This document is a contract which limits our liability. Please read this document carefully.

LIABILITY WAIVER

By participating in the recreational activities offered at Flipz Indoor Trampoline Park, you accept the risk of personal injury or death associated with those activities.

As such you agree to release to the full extent of the law Flipz Parkwood Pty Ltd, its directors, instructors, members, servants or agents from any claims or liability for:

• death; or
• a physical or mental injury of an individual (including the aggravation, acceleration or recurrence of such an injury of the individual); or
• the contraction, aggravation or acceleration of a disease of an individual; or
• the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual:
  • that is or may be harmful or disadvantageous to the individual or community; or
  • that may result in harm or disadvantage to the individual or community.

By signing this document, you agree that it is your expressed interest to release Flipz Academy Pty Ltd from any and all claims for professional or general liability, which may arise as a result of your participation in the activities including claims arising out of membership of Flipz Indoor Trampoline Park or participating in the activities offered at Flipz Indoor Trampoline Park, learning to trampoline (including the air bag), training to trampoline and using the equipment provided in connection with trampolining (including the air bag).

These conditions of entry apply to all persons entering Flipz Indoor Trampoline Park and Gymnastics Centre.

Flipz Academy priority is the safety of all participants at all times. This includes, but not limited to the overall behavior, both verbal & physical, of each participant in venue. In-appropriate behavior may result in your session being immediately cancelled. At all times participants are to keep their hands & feet to themself, to ensure we’re respecting each and everyone’s personal space.

You must comply with:

• these rules and responsibilities;
• all further rules specific to each activity area displayed on signage in that area; and
• any further directions issued by Flipz Indoor Trampoline Park staff.

YOU MUST NOT:

• consume alcohol either before or during participation in the activities;
• chew gum;
• smoke on the premises; or
• engage in any rough play / fighting.

Jumpers must not attempt skills beyond their own abilities increasing the risk of serious injury.

For safety and hygiene reasons:

• The maximum weight limit for an individual is 115kg;
• you must wear approved grip socks for the duration of the recreational activity; and
• mobile phones and other electronic devices must not be used during the recreational activity.

You (or, where you are not aged 18 or over, your parent/guardian) consent to:

• receiving any emergency medical treatment that Flipz Indoor Trampoline Park deems necessary during or after the engagement of the recreational activities, including the provision of first aid and calling an ambulance to attend if necessary; and
• paying any associated costs with the provision of that emergency treatment.

You are responsible for all your own personal property items on the premises at all times.

BY PARTICIPATING IN ACTIVITES IN THE VENUE YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE CONDITIONS OF ENTRY SET OUT ABOVE AND AGREE TO THEM. YOU ACKNOWLEDGE AND ACCEPT THAT SERIOUS ACCIDENTS CAN AND DO OFTEN OCCUR WHICH MAY RESULT IN SERIOUS INJURY AND YOU ACCEPT YOU ARE JUMPING AT YOUR OWN RISK.

BY WEARING THE FLIPZ SESSION WRISTBAND YOU ARE AGREEING TO THE TERMS AND CONDITIONS MENTIONED ABOVE.

You must be over 18 to sign this legal document. If you are under 18 the contract must be signed by a parent or guardian, in which case, you and the parent/guardian expressly agree to be bound by these conditions.

By signing this document, you acknowledge that you have read the FLIPZ Indoor Trampoline Park Rules & Responsibilities.
