CONDITIONS OF ENTRY & LIABILITY WAIVER
Flipz Academy Pty Ltd & Super Performance Centre Pty Ltd
Flipz Academy Pty Ltd and Super Performance Centre Pty Ltd (“Flipz Academy”, “we”, “our”, or “us”) provide recreational, gymnastics, trampoline, ninja obstacle and related physical activities within an indoor sporting environment.
By entering the facility, booking a session, or participating in any activities, you agree to the following Conditions of Entry and Liability Waiver.
1. Dangerous Recreational Activity
The activities conducted at Flipz Academy, including but not limited to trampoline use, gymnastics activities, ninja obstacle activities, tumbling, aerial and associated physical recreation, are classified as dangerous recreational activities.
Participation in these activities involves inherent risks which cannot be completely eliminated, including but not limited to:
- alling or landing awkwardly;
- collision with equipment or other participants;
- loss of balance or control;
- physical exertion and fatigue;
- equipment interaction;
- sprains, strains, fractures, spinal injury, paralysis or death.
By participating, you acknowledge and accept that serious accidents may occur and that you participate at your own risk.
2. Assumption of Risk & Release of Liability
To the full extent permitted by law, you agree that Flipz Academy Pty Ltd, Super Performance Centre Pty Ltd, and their directors, employees, contractors, instructors, and agents are not liable for any injury, loss, damage, or death arising from participation in recreational activities conducted at the venue, including but not limited to:
- physical or mental injury;
- aggravation or recurrence of an existing injury or condition;
- illness or disease;
- any other harmful or disadvantageous condition arising from participation.
You acknowledge that participation is voluntary and that you accept the inherent risks associated with dangerous recreational activities.
Nothing in this waiver excludes rights that cannot be excluded under Australian Consumer Law.
3. Wristband Acknowledgement System
All participants entering activity areas are required to wear a Flipz session wristband.
The wristband confirms that:
- the participant has agreed to these Conditions of Entry and Liability Waiver;
- the participant has acknowledged and accepted the risks associated with participation;
- the participant is registered and authorised to participate in activities at the facility; and
- the participant agrees to follow all safety rules and staff directions.
Conditions of Entry are displayed at reception, within the facility, and on our website prior to participation.
Participants not wearing a valid wristband are not permitted to participate in any activities.
4. Conditions of Entry
For the safety of all participants, you must comply with:
- all venue rules and responsibilities;
- all activity-specific rules displayed within activity areas; and
- all directions given by Flipz Academy staff.
Participants must not:
- consume alcohol or be under the influence of drugs or alcohol prior to participation;
- chew gum during activities;
- smoke on the premises;
- engage in rough play, fighting, or unsafe behaviour;
- attempt skills beyond their level of ability.
For safety and hygiene reasons:
- approved grip socks must be worn at all times during activities;
- mobile phones and electronic devices must not be used during activities;
- maximum participant weight limit is 115kg.
Flipz Academy reserves the right to remove any participant acting in an unsafe or inappropriate manner.
5. Medical Treatment Consent
You consent to receiving emergency first aid or medical treatment deemed necessary by Flipz Academy staff, including calling an ambulance where required. You acknowledge responsibility for any associated medical or ambulance costs.
6. Personal Property
Participants are responsible for their own personal belongings at all times. Flipz Academy accepts no responsibility for loss or damage to personal property.
7. Minors
Participants under the age of 18 must have this waiver accepted by a parent or legal guardian. The parent or guardian agrees to be bound by these Conditions of Entry on behalf of the minor.
8. Acknowledgement
By booking, entering the facility, participating in activities, or wearing a Flipz Academy wristband, you acknowledge that:
- you have read and understood these Conditions of Entry and Liability Waiver;
- you understand that serious injury can occur;
- you accept the risks involved in participation; and
- you agree to comply with all safety rules and staff directions.
You must be over 18 to sign this legal document. If you are under 18 the contract must be signed by a parent or guardian, in which case, you and the parent/guardian expressly agree to be bound by these conditions.
By signing this document, you acknowledge that you have read the FLIPZ Indoor Trampoline Park Rules & Responsibilities.
